Acting While So Employed (AWSE)

The grievor submitted that he was unfairly denied Acting While So Employed (AWSE) pay when additional duties were unofficially transferred to his position by decision of his Chain of Command (CoC), following an organizational restructure. As redress, the grievor requested acting pay at a higher rank for the relevant period.

The Initial Authority (IA) found that although the grievor's performance was excellent and he demonstrated exceptional task and time management skills, while performing both his normal and additional responsibilities, his work was done within the task requirements assigned by his CoC. As such, the grievor was neither posted nor appointed to a higher rank position and was not eligible for AWSE pay.

The Committee found that the grievor was not filling a position for which a rank higher than the member's substantive rank was authorized. The Committee determined that upon removal of a position from the organization, its duties were reassigned as additional duties. Thus, the Committee found that the grievor did not meet the conditions for acting rank set out in Queen's Regulations and Orders for the Canadian Forces article 3.05 and that the decision to deny the grievor's request for AWSE was warranted. The Committee recommended that the grievance be denied.
