The grievor was seeking Temporary Dual Residence Allowance (TDRA) for the full period that his residence at his former place of duty was on the market before selling. He argued that the TDRA eligibility requirement that the listing price of the house be consistent with the appraisal paid for by the Canadian Forces Integrated Relocation Program (CF IRP) and the market conditions is ambiguous. He also argued that he should not be denied TDRA because he relied on a professional real estate agent to establish his listing price.
The Director General Compensation and Benefits, acting as the Initial Authority (IA), found that the original listing price was not consistent with the appraisal and market conditions, but the reduced listing price was consistent. The IA therefore directed that TDRA be paid only for the period from when the price was reduced until the home sold.
The Committee, using only the information available to the grievor at the time he listed his home, evaluated whether his listing price met the consistency requirement for TDRA eligibility. It found, as had the IA, that the price was consistent only after it had been lowered. The Committee therefore recommended that the grievor be paid TDRA from the date of the reduced listing priced until the home sold.

The FA agreed with the Committee's findings and recommendation that the grievor be paid TDRA from the date of the reduced listing priced until the home sold. The FA also endorsed the Committee's systemic recommendation and asked DGCB to review the wording of the TDRA to clarify the condition that must be met for CAF members to leverage this benefit.
