The Committee found that the actions taken against the grievor, a Reservist, following his testimony before s Standing Court Martial were unjustified. It recommended that the Chief of the Defence Staff (CDS) acknowledge that the unit should not have threatened the grievor with a Change of Circumstance Report (CCR) review, that any document referring to a CCR be removed from his files, that his Personnel Evaluation Report (PER) be either rewritten and rescored or rescinded, and recommended that mediation be offered to restore a constructive and positive working environment as to facilitate his return to meaningful duties within the Intelligence community.

FA decision summary

The CDS partially agreed with the Committee's findings and recommendations. He directed that the grievor's 14/15 PER be replaced with an enclosed PER exemption, and that any reference to the CCR be removed from the grievor's personnel file and disposed of in accordance with the Library and Archives of Canada Act.
