The Committee had to determine whether the chain of command (CoC) dealt with allegations made against the grievor in accordance with the applicable policies, and whether there should be written documentation from the CoC to conclude the situation.

The Committee understood the grievor's request to obtain a formal letter of closure or, perhaps, minutes of a settlement, but these are documents which would usually be produced as part of a formal harassment or mediation process. Given that the situation was addressed informally, there would be no need to create such a record.

The Committee found that the Commanding Officer's intervention with respect to the complainant's allegation was appropriate and in accordance with the applicable policies. The Committee recommended that the grievance be denied.

FA decision summary

The Final Authority (FA) did not agree with the Committee's recommendation that the grievance be denied. The FA found no evidence that the grievor's actions at the time constituted harassment. The FA was satisfied that the grievor's intent was the welfare of his subordinate, even if she disagrees, and he exercised his supervisory and leadership functions when he counselled her on her breach of the chain of command.
