The grievor, a former Reservist who transferred to the Regular Force, complained that he was not provided with full temporary duty (TD) benefits when he was prohibited posted to Canadian Forces Base (CFB) Borden to attend his basic occupational training. As redress, he sought reimbursement of six months of rations and incidental expenses.

The Initial Authority (IA), the Director General Compensation and Benefits, denied the grievance, finding that the normal method for assigning non occupationally qualified members to CFB Borden for basic occupational training is to be prohibited posted, as was the grievor's case. The IA also noted that TD benefits would not be applicable under such circumstances.

The Committee found that the Basic Training Admin Guide (BTAG) provides guidance on the method of assigning a member to attend basic occupational training, and that it refers to “career status” as being a determining factor. The only way for a Reservist to meet the current career status definition is to have three or more years of Class C service. The Committee found that the grievor did not meet the career status definition and, therefore, that his assignment to CFB Borden by prohibited posting was reasonable and in accordance with policy.

The Committee observed that the BTAG ‘career status’ definition should be updated and should be more inclusive of all types of reserve service. The Committee recommended that the grievance be denied.
