# 2018-080 Medical and Dental Care, Medical treatment, Release - Medical
Medical treatment, Release - Medical
Case summary
F&R Date: 2019-07-30
The grievor argued that the Canadian Armed Forces (CAF) did not provide appropriate treatment for his mental health issues and that he was not released under the proper release item.
Although the Initial Authority (IA) was unable to complete a grievance decision within the time limit, the Director Medical Policy (D Med Pol) reviewed the grievor's personal health records at the IA's request and found that he had received mental health support consistent with the CAF standard of care. The D Med Pol also found that the permanent medical category and Medical Employment Limitation (MEL) assigned to the grievor were justified.
The Committee found that the grievor received responsive and coordinated multidisciplinary professional medical care for his mental health concern and that he was re-assessed on a regular basis.
Based on D Med Pol's subject matter expertise and the evidence on file, the Committee concluded that the grievor was assigned the appropriate medical category, MEL and release item. Consequently, the Committee found that the grievor was treated fairly and in accordance with the applicable policies. The Committee recommended that the Final Authority (FA) not afford the grievor redress.
FA decision summary
The FA agreed with the Committee's findings and its recommendation to not provide redress, finding that the grievor's medical care and release had been appropriate in the circumstances.
