The grievor contested a Recorded Warning (RW) he had been issued for a conduct deficiency. The Committee found that there was insufficient evidence to demonstrate, on a balance of probabilities, that the grievor had exhibited a conduct deficiency. The Committee also found that the description of the deficiency lacked sufficient precision and clarity as to the grievor's alleged conduct deficiency. Consequently, the Committee recommended the RW be rescinded and removed from the grievor's records.

FA decision summary

The Chief of the Defence Staff (CDS) partially agreed with the Committee findings and recommendations. The CDS agreed with the Committee's recommendation that the RW and related documents be expunged from the grievor's file. The CDS disagreed with the Committee's recommendation to consider that the RW issued to the other member at the same time and for the same incident be removed from his file for the same reasons. However, as part of the integrated conflict and complaint management process, the CDS reported that an informal resolution has been reached in the other member's case.
