# 2018-142 Careers, Prior Learning Assessment Review, Promotion

Prior Learning Assessment Review (PLAR), Promotion

Case summary

F&R Date: 2019-11-18

The grievor contested the date of his promotion to the rank of Captain. He argued he should have received more time in rank and the delay in the decision on his Prior Learning Assessment and Recognition Denial (PLAR) resulted in him being denied course loading for a required course. As redress, the grievor requested credit for time in rank as a Captain and retroactive pay.

The Initial Authority rejected the grievance for being submitted outside the timeline in article 7.06 of the Queen's Regulations and Orders for the Canadian Forces.

The Committee found that the PLAR denial was reasonable and the grievor had not substantiated that his promotion was delayed while waiting for the PLAR results. The Committee further found that despite his time in rank, the grievor was not eligible for promotion to Captain until he met all the course requirements.

The Committee recommended that the Final Authority not afford the grievor redress.

FA decision summary

The FA agreed with the Committee's findings and recommendation to not provide redress, finding that the grievor's promotion was not unfairly delayed.
