The grievor was contesting the pay level granted during his component transfer (CT) from the Reserve Force (Res F) to the Regular Force (Reg F). The offer he received and the transfer message did not show the same pay level.
The Initial Authority (IA) acknowledged that the offer presented to the grievor had the wrong pay level, but that it was corrected upon the issue of the CT message. The IA concluded that the error did not confer a right on the grievor and therefore denied the grievance.
The Committee found that the grievor's CT was conducted in accordance with applicable policies and that he was not aggrieved. However, the Committee noted that the error in the offer stemmed from the lack of a clear policy on the CT of officers from the Res F to the Reg F. Although the Chief of the Defence Staff, in a previous case, ordered that a clear policy on this point be implemented, such a policy still does not exist.
FA decision summary
The Director Canadian Forces Grievance Authority, acting as Final Authority, agreed with the Committee's findings and recommendation not to afford the grievor redress.
