The grievor, who held the rank of master seaman in the financial services administrator occupation, was appointed to the position of finance supervisor for a term of four months. The position was established at the rank of petty officer 2nd class (PO2). However, since the grievor did not have all the promotion prerequisites, she was not promoted. The grievor argued that she performed all the duties of the finance supervisor position and should have been promoted.

The Initial Authority acknowledged that the grievor had performed all the duties of a position at the PO2 level but could not give her the corresponding rank and pay because she did not have the prerequisites for promotion.

The Committee found that the Chief of the Defence Staff had already determined that the following three conditions allow for an acting while so employed (AWSE) promotion:

The Committee found that the grievor met all three of those conditions and recommended that the Final Authority (FA) grant an AWSE promotion at the rank of PO2 for the period during which the grievor was employed as the finance supervisor.
