The grievor challenged the denial of the education allowance for one of his children while serving outside Canada.
The Initial Authority (IA) determined that the school nearest to the grievor's post met the requirements of the Foreign Service Directive (FSD) 34 (Education Allowances). The IA therefore found that the denial of the grievor's request to have his child attend a school further away, for what he argued was a better program, was administered correctly and in accordance with the constructs of Compensation and Benefits Instruction (CBI) for the Canadian Forces.
The Committee found that, in accordance with the FSD and the CBI, the grievor's request did not meet “nearest to the post” requirement to be eligible for education allowance. Consequently, the Committee recommended that the Final Authority not provide the grievor redress.
