The grievor challenged not being offered terms of service (TOS) of an Intermediate Engagement of twenty years (IE20) in April 2005, and claimed that some of her peers were offered IE20 at the time. As redress, the grievor requested that she be offered an IE20 or equivalent TOS as her peers.

Following an administrative review into the grievor's TOS, the Director Military Careers Administration (DMCA) found that there was no evidence of an administrative error in the grievor's TOS offer and denied her request to convert her Continuing Engagement into an IE20.

The Committee determined that prior to May 2005, Commanding Officers had discretionary authority to offer IE20 TOS to members, based on criteria that had been established by the DMCA. The Committee found that the grievor had not provided any evidence of how she met the criteria to be offered an IE20 in April 2005.

Consequently, the Committee found that there was no error in the administration of the grievor's TOS and recommended that the Final Authority not afford the grievor redress.
