The grievor, a Naval Warfare Officer, challenged his reassignment to a different sub-occupation without being consulted. He contended that that it unduly denied him a promotion. He therefore requested to be reassigned to a sub-occupation of his choice.
The Initial Authority acknowledged that the grievor's reassignment to another sub-occupation was inadequately communicated but found that reassignment to the sub-occupation of his choice was unjustified.
The Committee found that the grievor was unduly reassigned to a different sub-occupation as his career progression did not give him the experience to perform well in his new sub-occupation. The Committee reviewed the grievor's performance at the various selection boards subsequent to his reassignment and found that his score may have been sufficient for a promotion in his previous sub-occupation. The Committee therefore recommended that the grievor be reassigned to his previous sub-occupation and that a supplemental board be conducted.
FA decision summary
The Acting Chief of the Defence Staff (CDS) agreed with the Committee's findings and recommendation to afford the grievor redress. Therefore, the Acting CDS directed that the Director General Military Careers conduct a supplementary board from the Fall 2016 to reassess the grievor's competitiveness in the Maritime Surface parent occupation for the 2017 Promotion Selection List.
