The grievor challenged an initial counselling (IC) he received for two conduct deficiencies. As the IC contained two separate issues, before analyzing the grievance, Naval Reserve Headquarters directed that the IC be replaced by two separate ICs. The Committee found that both ICs were fully justified and were issued in accordance with the policy.
FA decision summary
The Comd Royal Canadian Navy, acting as Final Authority (FA), did not agree with the Committee's findings and recommendation. The FA was of the opinion that serious errors were made in handling the issue, and therefore found that the first IC was not warranted.
As for the second IC, the FA determined that although it is possible that the grievor was intemperate and at fault in this case, the sum total of this file suggests that he was held to a different standard than his peers, and that an IC might not have been issued to other officers exhibiting the same behaviour. The FA directed that the remedial measures imposed to the grievor, his Personnel Evaluation Report for 2017/2018 as well as all documents referring to them, be removed from his personnel file. He also requested that Assistant Deputy Minister Review Services conduct a unit command climate survey at the earliest possible opportunity.
