The grievor was challenging the recommendation that she be released from the Canadian Armed Forces under Item 5(f) Service Completed – Unsuitable for Further Service of the table to the Queen's Regulations and Orders for the Canadian Forces 15.01. She claimed to have experienced harassment and abuse of authority and that the remedial measures that led to the recommendation were unfounded. She also claimed that this situation had led to a deterioration of her medical condition. The grievor maintained that, under the circumstances, the remedial measures were excessive and that the recommendation for release was unfair. She asked that the remedial measures be removed from her records and that the recommendation for release be withdrawn.
The Initial Authority did not render a decision within the prescribed time limit and the grievor asked that her grievance be sent to the Final Authority (FA).
After examining the progressive remedial measures taken in respect of the grievor by the commanding officer of two different units, the Committee noted that the nature of the deficiencies ascribed to the grievor were the same all throughout and that she had failed to overcome them despite the assistance and guidance provided. The Committee found that the recommendation for release was founded and reasonable and recommended that the FA not grant the grievor redress.
