The grievor argued that he should not have been posted to a new base because of his medical employment limitations (MEL), and that he should instead have been posted to the local area Joint Personnel Support Unit (JPSU).

There was no Initial Authority (IA) decision, as the IA failed to render a decision within the allotted time and the grievor did not grant an extension.

The Committee concluded that an administrative review of the grievor's MEL was underway at the same time that the grievor's upcoming posting was being planned by his career manager. The Committee found that, at the time that the grievor was denied a posting to the JPSU and was posted to a new base, his MEL did not support a JPSU posting and did not preclude his being posted to a new base.

The Committee noted that the posting message was cancelled after the Administrative review of medical employment limitations decision and recommended that no further redress be granted.

FA decision summary

The Final Authority (FA), the Director Canadian Forces Grievance Authority, disagreed with the Committee's findings and recommendation not to afford redress. While the Committee found that the Canadian Armes Forces followed the relevant policies correctly, and that the grievor disobeyed lawful orders, the FA found that the grievor's chain of command should have been more proactive in seeking to solve this situation.
