The Committee determined that the grievor was not treated fairly and in accordance with applicable rules and regulations when a Progress Review Board recommended and the Commandant directed his removal from the Phase 1 Primary Flying Training. The Committee recommended that the grievor be allowed to return to pilot training when his medical condition allows it.
FA decision summary
The Commander Royal Canadian Air Force, acting as Final Authority (FA), agrees partially with the Committee's findings. As for its recommendation, following the latest representations by the grievor, in which he stated that he would not be able to complete the pilot training and restricted release period prior to his eligibility for normal retirement with 25 years of service, he amended his request for redress. The FA finds that, on a balance of probabilities, the grievor's removal from training was simply due to his inability to meet the standards of the course. The FA finds that the grievor was treated in accordance with the policies and he did not afford the grievor redress.
