The grievor was posted outside Canada while one of his dependants remained in Canada attending high school. In 2018, the grievor was posted back to Canada, to a different province. He sought to take advantage of Compensation and Benefits Instruction (CBI) 12.1.03(7), which provides that if a member is posted from one province to another and their dependant child is in the final two years of high school, they may claim an education allowance to permit the child to finish high school in the province the member is posted away from.

The Committee found that there was no authority to provide the benefit to the grievor, as the CBI explicitly required that a member be posted from one Canadian province to another. However, it noted that the Final Authority might wish to review this with the Treasury Board.
