The grievor grieved that his promotion to the rank of Sergeant (Sgt) was cancelled after he accepted an offer for the University Training Plan for Non-Commissioned Members (UTPNCM) program.
The Acting Director General Military Careers, acting as the Initial Authority (IA), determined that the grievor voluntarily accepted the UTPNCM offer, and that there was no service requirement to promote and employ the grievor as a Sgt. As the grievor was treated in accordance with the UTPNCM and the promotion policy, the IA concluded that the grievor was not aggrieved and did not grant redress.
The Committee found that there was no service requirement to promote the grievor. The Committee also found that the decision to cancel the grievor's promotion to Sgt after he accepted the UTPNCM offer was reasonable and policy compliant.
The Committee recommended that the Final Authority not afford the grievor redress.
FA decision summary
The Final Authority (FA), the Director Canadian Forces Grievance Authority, agreed with the Committee's recommendation that the grievor not be granted redress. The FA agreed with the Committee's finding that, although the grievor had been eligible for promotion to the next non-commissioned member rank, upon the grievor's acceptance of a University Training Plan for Non-Commissioned Members offer, the service requirement for the promotion no longer existed, and cancelling the promotion was reasonable and in accordance with the applicable rules and policies.
