The grievor alleged that the decision to relieve him of his duties was arbitrary, based on false and malicious allegations, and that he had never been informed of the actual reasons. He also maintained that the personnel evaluation reports (PERs) that he was shown, after he had been relieved of his duties, were unfair and did not reflect his performance and potential.

Given that the grievance had to do with the decision of an officer who reports directly to the Chief of the Defence Staff, the file was assigned directly to the Final Authority (FA).

The Committee found that the grievor showed a blatant lack of ethics by placing himself in a conflict of interest situation. More specifically, by using his position to his own advantage, he put his own personal interests before those of the Government of Canada. The Committee also found that, during his service, the grievor regularly made rude remarks to civilian personnel he had contact with in the course of his work, despite several discussions that the grievor's supervisors had had with him. Lastly, the Committee found that the PERs given to the grievor after his removal from his duties were fair.

The Committee recommended that the Final Authority (FA) not grant redress.
