The grievor contended that he had been submitted to unfair treatment during an occupation qualification course. The Initial Authority agreed and noted that following other allegations concerning the same training establishment during the same timeframe, an administrative investigation had been conducted and remedial steps had been taken. He directed that the grievor's student file be corrected and that the training establishment organize a professional development session on diversity and cultural sensitivity and Officer Commanding sessions to reinforce the Department of National Defence/Canadian Armed Forces (DND/CAF) Code of Values and Ethics. The Committee also found that the grievor had been treated unfairly and recommended, in addition to the measures previously implemented, that the Final Authority (FA) express regret on the part of the CAF for the circumstances which occurred.

FA decision summary

The FA, the Acting Commander of the Canadian Army, agreed that the grievor had been treated unfairly and offered his apologies on behalf of those who had caused the injury. He noted that no CAF members who had been involved in the incidents remained at the training establishment and that as a direct result of the grievor's complaint, staff had received three separate courses related to hateful conduct and harassment, another on ethics and values, and briefings from the Commander and senior staff on instructor deportment and conduct.
