The grievor was issued an initial counselling (IC) for performance deficiency for being delinquent in the completion of his training. He argued that there were no facilities nor opportunities available for him to complete his training.

The Initial Authority, the grievor's Commanding Officer, corrected some minor calculation errors in the time expired in two of the grievor's three training packages but concluded that the IC was justified and warranted.

The Committee noted that, since his progress was calculated as a percentage and assessed against established standards, the grievor's training progress was quantifiable, measurable, and calculable. The Committee concluded that the grievor was behind in the three training courses in question and that the IC was based on reliable evidence as required by the Defence Administrative Orders and Directives 5019-4, Remedial Measures. The Committee recommended that redress not be granted.

The Commander Royal Canadian Navy, acting as Final Authority, agreed with the Committee's findings and recommendation not to afford the grievor redress.
