The grievor was issued an initial counselling (IC) for a performance deficiency for his performance during a fire fighting exercise. He argued that a faulty valve prevented him from charging and rigging his hose as he was required to do.
The Initial Authority, the grievor's Commanding Officer, found that the IC was justified and warranted.
The Committee first noted that witnesses confirmed that the valve was faulty. However, the witnesses also noted that, apart from the stuck valve, the grievor was otherwise not prepared to perform his duties. The Committee found, based on a balance of probabilities, that the witness statements constituted reliable evidence of the grievor's deficiency, as required by the Defence Administrative Orders and Directives 5019-4, Remedial Measures. Therefore, the Committee recommended that redress not be granted.
