The grievor argued that it was unfair that his daily rate for meals and incidentals had been reduced to 75% after 30 days when he was on temporary duty (TD). He contended that since his accommodations did not have cooking facilities, he should be entitled to the full daily rate for the duration of his TD.

The Committee determined that the grievor's travel was governed by the Treasury Board approved Canadian Forces Temporary Duty Travel Instructions. Further, in accordance with articles 7.16 and 7.18 of those instructions, the Committee found that the grievor's meals and incidental rates were correctly reduced on the 31st day of his TD. Consequently, the Committee recommended that the Final Authority (FA) not afford the grievor redress.

FA decision summary

The FA agreed with the Committee's findings and recommendation, finding that pursuant to CFTDTI 7.16 and 7.18, from the 31st day of travel onwards the grievor was entitled to 75% of the 100% rate for meals and incidentals set out in the National Joint Council Travel Directive regardless of the type of accommodation he occupied.
