The grievor complained that he had been posted to a higher ranked position in 2018 but was only promoted in an acting while so employed (AWSE) capacity rather than substantively. The Initial Authority only examined the grievor's competitiveness on the 2019 Selection Board (SB) and determined that he did not score high enough on the selection board candidate list (SBCL) to be considered by the 2019 SB.

The Committee confirmed that the grievor had ranked 11th for promotion in 2018 and, since there were only three promotions in the grievor's occupation that year, the Committee found that promoting him AWSE was correct. The Committee also determined that since the grievor had received two Personnel Evaluation Report Exemptions in the two years preceding the 2019 SB, his Career Manager should have reviewed the grievor's file for competitiveness rather than relying solely on the computer generated SBCL score. As there was no evidence that this had been done, the Committee undertook a review of the grievor's file and found it to be sufficiently competitive that it should have been assessed by the 2019 SB. Consequently, the Committee recommended that the Final Authority (FA) direct that a Supplementary SB be convened to rank the grievor for promotion in 2019.

FA decision summary

The FA agreed with the Committee's findings and recommendation, and directed the Director General Military Careers to conduct a supplementary promotion board.
