The grievor contended that after being selected for the University Training Plan for Non-Commissioned Members (UTPNCM), he was denied his promotion to Master Corporal (MCpl), which he had been informed would happen that year. He acknowledged that normally members are not promoted following selection for UTPNCM, but argued that since he was filling a MCpl position, he should have been promoted.
The Initial Authority agreed that the intent had been to appoint the grievor to MCpl and post him to a position at the higher rank. However, once the grievor was selected for UTPNCM, there was no sense in posting him to a MCpl position for a short period and, as he was not filling a MCpl position, there was no service requirement to appoint him to MCpl.
The Committee found that the grievor had never been posted to a MCpl position and there was therefore no requirement to appoint him to that rank. However, the Committee found that the grievor had been filling the duties of a MCpl, who was on maternity leave for approximately five months. The Committee therefore recommended that the grievor be appointed to MCpl Acting While So Employed for that period.
FA decision summary
The Final Authority, Director Canadian Forces Grievance Authority, agreed with the Committee's findings and recommendation, and directed the Director General Military Careers to appoint the grievor MCpl Acting While So Employed for the time spent carrying out the duties and responsibilities commensurate with that appointment.
