Case summary

The grievor challenged the chain of command's administration of his commissioning from the ranks (CFR) request. As redress, he asked that his CFR request be reinstated and backdated to the initial approval date. The Initial Authority found that the chain of command revoked support for the grievor’s CFR based on dissatisfaction with his conduct and performance.

The Committee found that the grievor was denied procedural fairness when his chain of command did not notify him it had revoked its CFR nomination nor provide him with reasons for doing so. While the Committee noted that in most cases the grievance process corrects any breach of procedural fairness, it found in this case that the Canadian Armed Forces' lack of response to the Committee's enquiries left it with insufficient evidence to assess the factual basis for the withdrawal of the grievor's CFR nomination.

Accordingly, the Committee recommended that the Final Authority (FA) afford redress by directing the grievor’s chain of command to continue his CFR process from  the point at which it was discontinued.

FA decision summary

The FA agreed with the Committee's findings and recommendation, and directed that the CFR process resume from the point at which it had been discontinued.
