The grievor challenged the prior learning assessment conducted when she enrolled. She requested double credits to recognize prior education and a second employment, and that she receive partial credits for periods less than two full years.

The Director General Compensation and Benefits, acting as Initial Authority (IA), explained that under subsection 204.015(2) (Qualifying service) of the Compensation and Benefits Instructions applicable to the Canadian Forces, the Chief of the Defence Staff publishes the Military Occupation List – Incentives and Allowances (Regular Force). This list is the order that governs pay credits that may be offered. The IA determined that double and partial credits are not covered.

The Committee concluded that years of relevant civilian experience are counted in real time and that the policy does not provide for granting credits for periods less than two years. The Committee recommended that redress not be granted. 

FA decision summary

The Chief of the Defence Staff agrees with the Committee's recommendation to not grant the grievance. As with the Committee, the Chief of the Defence Staff concluded that Compensation and Benefits Instruction (CBI) 204.015(1) is used to determine the rate of pay on enrolment which reflects academic training and other qualifications determined to be of military value. The Chief of the Defence Staff concluded that the grievor received the maximum credit for their years of civilian practice and that the CBI did not allow to offer them additional increments for their military service post-enrolment. The Chief of the Defence Staff also ordered Director General Compensation and Benefits to complete a verification of pay accounts for members of the legal branch who would have received additional pay increments for partial years.
