At the time when the grievor wished to component transfer (CT) from the Regular Force (Reg F) to the Reserve Force (Res F), there were no positions available at his rank level. He therefore requested a permanent relinquishment of his rank in order to CT into an available position. The CT offer clearly stated that should he be promoted in the future, his time served in his previous higher rank would not be counted in calculating his pay increment (PI) level. The grievor accepted the offer. A year later, the grievor was promoted to his previously held rank and assigned PI level ’Basic’. He contended that he should receive PI level 6 as that is what he was receiving when he previously held that rank in the Reg F.
The Committee found that, in accordance with paragraph three of article 204.511 of the Compensation and Benefits Instructions for the Canadian Forces, the grievor's time in the previous rank in the Reg F could not be counted when he was promoted to that rank in the Res F. When the grievor accepted the CT offer, which included a permanent relinquishment of his rank, his entitlements to a higher PI level upon promotion was lost. Consequently, the Committee recommended that the grievance be denied.
