In her grievance, the grievor challenged the treatment of her traumatic brain injury by the Canadian Forces Health Services (CF H Svcs). As redress, she requested a total of $8,800 in educational funds to complete her Anesthesia Assistant and Nurse Practitioner training, which she had had to discontinue following her injury. The Initial Authority did not render a decision.

The Committee noted that Canadian Armed Forces (CAF) members are entitled to medical care pursuant to Article 34.07 of the Queen's Regulations and Orders for the Canadian Forces, and that CAF commanders must ensure that the health care needs of personnel under their command are met with in accordance with the CAF Spectrum of Care (SoC).

The Committee obtained and thoroughly reviewed the grievor's medical records. Contrary to the grievor's contentions, the records did not demonstrate that CF H Svcs personnel ignored or neglected her treatment. Rather, they demonstrated that CF H Svcs authorities appropriately managed the grievor's medical care in accordance with the SoC and clinical best practices. The Committee also found that CAF authorities managed the grievor's sick leave, medical employment limitations and medical release processes in accordance with applicable policies.

Concerning the grievor's request for funds to continue her specialty training, which had been interrupted by her injury, the Committee noted that Compensation and Benefit Instruction 210.80 - Tuition Fees, Books and Instruments, authorizes the Chief of the Defence Staff to waive educational fee limits in some circumstances. In recognition of the grievor's years of CAF service and, in accordance with CAF transition principles, the Committee recommended that the Final Authority authorize the grievor’s $8,800 request for her Anesthesia Assistant and Nurse Practitioner education.  

The Committee did not recommend further redress.
