The grievor was the Commanding Officer of a cadet squadron. Following a number of complaints from cadets and parents, the grievor received two initial counselling (IC) for conduct and performance deficiencies. The conduct IC addressed the grievor's yelling, use of profane language and his disrespectful and uncooperative attitude. The performance IC listed numerous deficiencies related to a lack of leadership and planning, and required the grievor to draft a guidance document to help him address those deficiencies. The grievor challenged both ICs.

The Initial Authority found that the ICs were reasonable and that the grievor had been treated in accordance with the applicable regulations and policy. 

The Committee found no bias or procedural unfairness in the decision to impose the ICs. Concerning the conduct IC, the Committee found that the statement concerning yelling and profane language was warranted. However, the comments about the grievor's attitude should be removed. Concerning the performance IC, the Committee found that, while some rewording was required, the record substantiated all of the listed deficiencies. However, the grievor failed to draft an adequate guidance document as required by his performance IC; consequently, a more severe remedial measure should have been initiated. The Committee recommended imposing a recorded warning with respect to the performance deficiencies.
