The grievor indicated that she was grieving her chain of command's decision to deny the distribution of her administrative review of medical employment limitations (AR/MEL) representations letter to a distribution list of her choosing. The grievor indicated that she wanted her representations distributed to the list she compiled because she wanted her situation to be shared in the hopes that it would make it easier for members in the same situation.

The Initial Authority did not render a decision as the grievor opted to forward her grievance to the Final Authority (FA) after four months had passed.

The Committee found that there was no policy or directive setting out a requirement to distribute a member's representations, as part of the AR/MEL process, to a distribution list compiled by that member. However, the Committee did find that Defence Administrative Orders and Directives 5019-2, Administrative Review clearly indicates that all AR/MEL information is to be compiled through the Administrative Review analyst at the Directorate Military Careers Administration. As such, the Committee found that the grievor was not entitled to have her representations distributed to the list she compiled and that, as determined by her chain of command, it would be inappropriate to send the representation to all the parties listed.

The Committee recommended that the FA not afford the grievor redress.
