The grievor, a former reservist, left his position as a senior public servant at the Department of National Defence (DND) to transfer to the Regular Force (Reg F). He argued that he did not receive proper credit for his prior experience upon transfer to the Reg F. As redress, he sought a promotion, backdated to his transfer date.

The Initial Authority (IA), the Chief of Military Personnel/Commander Military Personnel Command (CMP), denied redress. The IA explained that the grievor was lacking exposure to the full breadth of his occupational functions. The IA found that the transfer offer at the lower rank was properly administered and denied redress.

The Committee first noted that paragraph 4.3 of the Canadian Forces Military Personnel Instruction 03/08 – Canadian Forces Component Transfer and Component Transfer Career Programs, provides that civilian experience is one of four elements that a Prior Learning Assessment and Recognition (PLAR) process must consider. Next, the Committee found that, although the grievor's military service was recognized in the PLAR process, his civilian experience was not properly valued. The Committee concluded that the grievor did not receive full recognition for his civilian experience.

The Committee observed that the grievor's circumstances demonstrated a certain resistance within CMP to fully employ the various policies and administrative instructions permitting the recognition of civilian experience, especially DND civilian experience. The Committee noted that doing so is vital to successfully recruiting and retaining top talent.

The Committee recommended that the Final Authority grant redress.
