The grievor received a recovery request from the Director Compensation and Benefits (DCBA) for moving costs for their household goods and effects (HG&E). They took out a bank loan to reimburse the amount claimed and temporarily stop the recovery procedure. However, they contested the decision by the DCBA to refuse their request to cancel the recovery. The grievor maintained that they were entitled to the storage of their goods for the period during which they waited to take possession of their new residence. As redress, the grievor requested a reimbursement of the moving costs of their HG&E, storage costs, and interest accumulated with the banking institution.

The Committee concluded that the grievor's situation did not meet the criteria for reimbursement of storage costs under subsection 9.1.04 of the Canadian Forces Integrated Relocation Program (CFIRP) Directive.

The Committee also concluded that the grievor met the conditions set out in subsection 1.1.03 of the CFIRP Directive and was eligible for an authorized relocation at public expense. However, the grievor was eligible only for reimbursement of the cost of transportation of their HG&E from the storage facility to their new residence.

Finally, the Committee concluded that in the absence of an express provision to that effect, it could not recommend to the Chief of the Defence Staff that the grievor be reimbursed for the interest paid to the banking institution.

The Committee recommended to the Final Authority (FA) that the grievor be reimbursed for the cost of transportation of their HG&E from the storage facility to their new residence.

FA decision summary

The FA, the Director Canadian Forces Grievance Authority agreed with the Committee's recommendation to partially uphold the grievance. The FA found that the grievor was not eligible for reimbursement of storage costs and ordered reimbursement of transportation costs for the grievor's household goods and effects.
