The grievor was informed that he would be reimbursed if he hired a real estate broker to buy a home with respect to his deployment, but the Director Compensation Benefits Administration denied his request for reimbursement.
The Director General Compensation and Benefits, acting as Initial Authority, explained that the Canadian Forces Integrated Relocation Program (CFIRP) Directive provides for reimbursement for brokerage fees only when a home is sold and, as a result, denied the request for reimbursement.
The Committee determined that although the grievor was not eligible to receive a reimbursement under the CFIRP, the Canadian Armed Forces had misled him by making a negligent misrepresentation. The Committee recommended that the Final Authority refer the case to the Director claims and civil litigation for review.
