The grievor claimed they were entitled  to the monthly aircrew allowance (AIRCRA), in accordance with Compensation and Benefits Instructions (CBI) 205.32, while posted to an Operational Training Squadron (OTS) and while attach posted to an Operational Squadron (Sqn). 

The Initial Authority (IA) partially granted the grievance. The IA determined that the grievor, as an aircrew member, was not entitled to AIRCRA (monthly) while posted to the OTS. The IA found that the grievor did not occupy a designated position, given that they were on basic training list (BTL) status, and were not employable in their occupation. However, the IA found that the grievor met the condition of being in a designated position during his attach posting to a Sqn, where all positions were designated for AIRCRA. The IA found that the grievor met all of the conditions for entitlement to payment of AIRCRA (monthly), as set out in CBI 205.32, during his attached posting period.

The Committee found that CBI 205.32(3) identified three conditions for entitlement to AIRCRA (monthly). An aircrew member had to occupy a designated position, report for duty in the designated aircrew position and not be disentitled under CBI 205.29 (Environmental Allowances Matrix) or CBI 10.3.08 (Environmental Allowances).

The Committee found that the grievor was an aircrew member posted to the OTS' BTL to continue their flying training. Based on this, the Committee found that the grievor was not posted to an accountable position at the unit nor did they fulfill the obligations associated with such a position in a designated unit. In accordance with CBI 205.10(4)(b), the Committee agreed with the IA that the grievor was seen as occupying  a designated position while assigned, by attached posting, to a unit where all of the positions were designated positions. The Committee found that the grievor met the conditions for entitlement to payment of AIRCRA (monthly), as prescribed by CBI 205.32(3), during the period that they were attach posted to the Sqn.

The Committee recommended that the Final Authority afford partial redress by directing payment of AIRCRA (monthly) to the grievor for the period of their attached posting.
