The grievor contested the decision to deny his request for an extension of the compulsory retirement age (CRA) to 65. He alleged there was a breach of procedural fairness in that he was not given sufficient opportunity to make submissions or informed of all the information used to make this decision. 

There was no Initial Authority decision because, in accordance with subparagraph 7.13(b) of the Queen's Regulations and Order for the Canadian Forces (QR&O), the contested decision was made by the Chief of Military Personnel, who reports directly to the Chief of the Defence Staff. 

The Committee found that the decision to deny the grievor's request for CRA extension was justified and in accordance with article 15.17 of the QR&O and other applicable policies. The Committee also found that there was no evidence to suggest that the grievor was not afforded procedural fairness. 

The Committee recommended that the Final Authority not afford the grievor redress.
