# 2021-234 Careers, Misuse of Alcohol, Recorded Warning
Misuse of Alcohol, Recorded Warning (RW)
Case summary
F&R Date: 2022-08-22
The grievor received a Recorded Warning (RW) for conduct for consuming more alcohol than permitted under Roto 9 Theatre Standing Order (TSO) 104. The Committee had to determine whether the RW was justified and administered in accordance with Defence Administrative Order and Directive 5019-4, Remedial Measures.
The Initial Authority (IA) determined that, on a balance of probabilities, the RW was warranted. The IA found that the grievor liberally interpreted the TSO and failed to correctly comprehend the intent of the policy and abide by it, representing a conduct deficiency warranting correction.
The Committee found that the RW for conduct was justified as, based on a balance of probabilities, the evidence showed that the grievor consumed more alcohol than Roto 9 TSO 104 permitted.
The Committee recommended that the RW for conduct remain on file but that the deficiency description in the grievor's RW be redrafted to remove the content related to a performance deficiency and specify the date of the incident that led to the conduct deficiency.
FA decision summary
The Director Canadian Forces Grievance Authority, acting as Final Authority, agreed with the Committee's findings and recommendation not to grant the grievor redress, but that the deficiency description of the RW be redrafted.
