The grievor objected to the way her chain of command (CoC) had handled her workplace harassment situation. She explained that instead of getting help, she had been repeatedly bullied into opting for a mediation process. The grievor alleged that, as a result of the lack of help from her CoC, her health had deteriorated, and she could no longer function as before.
As redress, the grievor asked that her legal fees be reimbursed and that she be financially compensated for her health problems.
The Initial Authority found that the grievor had not filed her grievance within the prescribed time limit and that it was not in the interests of justice to allow it.
The Committee concluded that Defence Administrative Order and Directive 5012-0 and the Harassment Prevention and Resolution Instructions do not provide for the possibility of legal aid for the grievor, nor for the funding thereof. The Committee therefore found that the grievor was not entitled to have her legal fees reimbursed.
With regard to the claim for financial compensation for health problems, the Committee found that the grievor had not demonstrated that her complaint that she had been harassed by the respondents had been handled in an inappropriate and unwarranted manner. Consequently, the Committee recommended that the Final Authority not grant the grievor redress.
