The grievor claimed that they should have been promoted, with the associated increase in pay, upon completion of the academic requirements for their degree at the Royal Military College.

There was no Initial Authority decision as the Director General Compensation and Benefits could not determine the grievance within the time limit prescribed by article 7.15 of the Queen's Regulations and Orders for the Canadian Forces.

The Committee found that upon completion of the academic requirements for their degree, the grievor was either under investigation for conduct deficiencies, on counselling & probation, or undergoing an administrative review to consider the viability of their continued service in the Canadian Armed Forces. The Committee found that during this time, there were valid reasons for not recommending the grievor's promotion and that the grievor's misconduct was serious enough to warrant a recommendation for release. Therefore, the Committee found that a promotion recommendation prior to the date in question was not merited based on the grievor's conduct deficiencies.

The Committee found that the grievor's promotion date and associated pay were established in accordance with the applicable policy.

The Committee recommended that redress not be granted.
