Medical Treatment
Case summary
F&R Date: 2023-12-01
The grievor wished to ensure that her medical condition and the inadequate treatment she had received for three and a half years could be considered as a whole. She believed that the medical staff had never taken her medical condition seriously and that she had not benefited from regular follow-ups since she injured herself during her recruit course. The redress she is seeking is to have her case taken seriously and to have each problem be considered.
The Director of Medical Policy, acting as a subject matter expert, confirmed that the grievor was receiving simultaneous care for all her health problems and that a calendar of all future appointments had been put in place and discussed with her. In light of this opinion, the Initial Authority (IA) held that the new medical commitments undertaken to allow the grievor to have rigorous follow-ups were feasible and sustainable solutions for the continuation of appropriate treatment. The IA found that the grievor received the care that was appropriate for her medical condition and in compliance with the applicable provisions.
The Committee found that there was no evidence that the Canadian Armed Forces (CAF) had ignored the grievor's concerns. The Committee also found that the CAF had assumed its responsibilities by implementing measures to ensure that the grievor received the care she required.
The Committee recommended that the Final Authority deny redress to the grievor.
