The grievor disputed the decision by Canadian Armed Forces Business Information Services (BIS) to refuse to update his current Member's Personnel Record Resume with the addition of historical data related to his previous Reserve Force service.

The Director General Military Personnel Support Services, acting as the Initial Authority, failed to render a decision within the time limit prescribed by Queen's Regulations and Orders for the Canadian Forces article 7.15.

The Committee found that in accordance with chapter 10 of Military Human Resources Records Procedures, the grievor's request should have been forwarded with supporting documentation, through his Chain of Command (CoC) to the Career Manager (CM), who would then determine what information, if any, had a bearing on the grievor's further career decisions and whether there was a valid career reason to action the request.

The Committee found that in this instance, the proper process was not followed by the grievors CoC and the grievor's request was denied as a result. The Committee recognized that the denial by BIS was justified in accordance with the applicable policy but found that the grievor had been aggrieved by the lack of support from his CoC in appropriately staffing his request.

The Committee recommended that the Final Authority direct that the grievor's CoC restaff the request properly through the CM so that it could be considered in accordance with the applicable provision.
