The grievor contested the decision made by the Director Compensation and Benefits Administration to deny his request for reimbursement of the relocation expenses he incurred to move his effects from Halifax to Kingston as well as a posting allowance.

The Initial Authority (IA) denied the grievance. The IA found that the grievor had not received an “official” posting to the Royal Military College (RMC) in Kingston, only an attached posting, and determined that he was not entitled to the reimbursement of relocation costs from Halifax to Kingston because he had waived his entitlements to any benefits. The IA also determined that the grievor was not entitled to a posting allowance as she found that when the grievor was posted from Halifax to a unit in Kingston, it was determined to be a no cost move as the grievor and his personal belongings were already in Kingston.

The Committee found that the grievor was eligible for a cost move from Halifax to Kingston to attend his chosen academic program in person at the RMC. As such, the Committee found that it was not appropriate to require that the grievor accept an attach posting or that he be required to waive his entitlements. The Committee noted that if the grievor had been correctly posted to Kingston, he would have been entitled to move his effects when he went to Kingston and to receive a posting allowance. Further, the Committee opined that had the grievor taken his effects with him to Kingston, he would not have had to incur the expense of returning to Halifax to retrieve them.
