The grievor contested the decision to have his file referred to the Military Police Credential Review Board (MPCRB), stating that he was not informed of the seriousness of a physical altercation that took place at a party in the Residential Housing Unit while he was the on-duty Military Police and that no complaint of a criminal offence had been submitted by anyone. The grievor opined that the Security and Military Police Information System (SAMPIS) reporting threshold was not met and, as such, he did not report it in SAMPIS or to his chain of command (CoC). The grievor requested that the referral of the matter to the MPCRB be retracted.
The Initial Authority (IA) denied the grievance. The IA stated that to render a decision before the MPCRB convened to consider the case, would undermine the Commander Canadian Forces Military Police Group's authority and would be considered interference with policing matters.
The Committee found that the decision to refer the grievor to the MPCRB was justified. The threshold was met for a referral to the MPCRB given that the grievor's omissions and failure to report the incident in SAMPIS or to his CoC, could have brought discredit to the Canadian Armed Forces and possibly breached the Military Police Professional Code of Conduct.
The Committee recommended that the Final Authority not afford the grievor redress.
