The grievor contested the decision not to convene a Board of Inquiry (BOI) into his Chain of Command's (CoC) refusal to administer his Summary of Conduct, his Report of Injury (CF 98), his Workplace Violence Reports (WVRs) and his grievance. The grievor stated that he submitted these summaries, reports and grievances as he was the target of acts of insubordination, workplace violence and bullying during exercises held in September 2020 and that the inaction from his CoC impacted his safety and wellbeing. As the grievor's request for a BOI was denied, he asked that the matters be investigated by a third party and that the findings be made available to him.

There is no Initial Authority decision on this file as the matter was referred directly to the Final Authority.

The Committee found that the grievor's CoC did not fulfill its responsibilities in accordance with subparagraph 4.02(1)(c) of the Queen's Regulations and Orders for the Canadian Forces by failing to ensure that the grievor's allegations set out in his Summary of Conduct, the CF 98, his WVRs and his grievance were appropriately administered and addressed.

The Committee recommended that the Chief of the Defence Staff consider the granting of an ex gratia payment to the grievor.
