The grievor, a Reservist, grieved the requirements for application to the Military Medical Training Plan (MMTP), which restricts applications to Regular Force (Reg F) members only, thereby excluding the grievor from applying to the MMTP. The grievor believed his circumstances were unique, including that he had been employed on Class ā€œCā€ terms of service for an extended period of time within the same unit, and but for the lack of an officer trade specifically within the unit, he would be a Reg F member and would therefore qualify to apply for the MMTP. He noted that he was not seeking to amend the relevant policy, but given his unique circumstances, he should be permitted to apply.

The Initial Authority rejected the grievance based on the grievance being submitted beyond the time limit found in Chapter 7 of Queen's Regulations and Orders for the Canadian Forces, and that it would not be in the interests of justice to consider it.

The Committee reviewed Canadian Forces Administrative Order 9-62 – Military Dental, Legal, Medical, Chaplain and Pharmacy Training Plans, which makes clear that to be eligible for selection for the MMTP, an officer must be a member of the Reg F. The Committee stated that the CAF has the authority to create a Reg F specific program which takes into consideration the needs of the CAF, as well as differing liabilities for service between the Reg F and the Reserve Force. The Committee noted that the grievor was not precluded from transferring to the Reg F, but that the grievor considered that if he did, he would likely no longer be employed at the same unit, if not successful with the MMTP application.

The Committee found that the grievor's circumstances were not exceptional, and that the grievor was not aggrieved.
