The grievor contested the decision to cease her training in the Personnel Selection Officer (PSO) – Occupational Qualification course. The grievor asserted that events which resulted in her removal from the course were misrepresented. She attributed her poor performance, in part, to the toxic environment caused by a mishandled situation by the course staff. As redress, the grievor sought to be granted the course qualification, to be allowed to continue her career in the Canadian Armed Forces and to complete her PSO on-the-job training.
The Initial Authority (IA) determined that the decision to cease the grievor's PSO training was warranted and that the grievor had been treated fairly and in accordance with applicable policies. The IA asserted the grievor's conduct fell short of the extremely high standard for PSOs on multiple occasions and that her chain of command (CoC) followed proper procedures.
The Committee found that it was reasonable for the CoC to have concerns about the grievor's suitability as a PSO given the multiple incidences of her unprofessional conduct during the course. The CoC also provided the grievor with progressive warnings that were more than judicious. The Committee also found that the Performance Review Board (PRB) did not violate the principles of procedural fairness, as the grievor was given all documentation used in the decision to cease her training and she was able to make representations. As a result, the Committee found that the decision of the PRB to cease the grievor's training was in accordance with the applicable policies.
The Committee recommended that the Final Authority not afford the grievor redress.
