The grievor claimed that the Canadian Armed Forces failed to follow up on the results of her medical tests, causing her unnecessary suffering due to a delayed diagnosis and treatment that she received over two years later. The grievor submitted that the level of care that she received demonstrated negligence and malpractice. As redress, the grievor requested an investigation into her treatment and to be informed of the results of that investigation, in addition to compensation for pain and suffering. 

The Surgeon General, acting as the Initial Authority (IA), partially granted redress. The IA requested an investigation into the quality of care provided to the grievor. This investigation was completed by the Directorate of Quality and Performance who conducted a chronological review of the grievor's medical appointments and concluded that the grievor's continued symptoms and further tests were required before an official diagnosis could be rendered. The IA explained that while they do not have the authority to address the grievor's request for compensation for pain and suffering, they found, based on the results of the investigation, that the grievor had been treated reasonably and in accordance with applicable policies. 

The Committee considered whether the investigation that was conducted and whether its conclusions were logical and coherent with the information available in the grievor's medical records. The Committee found the investigation report to be indicative of a thorough and unbiased review based on the grievor's recorded medical information. Further, the Committee found that the quality of care given to the grievor was reasonable for the information that was available at the time and the nature of the grievor's medical condition. Regarding the grievor's claims of medical malpractice, as well as pain and suffering, the Committee found that such claims are under the jurisdiction of Veteran Affairs Canada. The Committee recommended that the Final Authority not afford the grievor redress.
