The grievor contested the parameters of an offer of a component transfer (CT) to the Regular Forces. In his grievance, the grievor claimed that the Canadian Armed Forces did not take his seniority and posting preferences into account, which had repercussions for the calculation of his enter promotion zone (EPZ) date, pay increment and proposed rank in the CT offer. As redress, the grievor asked that his EPZ dates for the ranks of lieutenant and captain be reviewed and that he receive the appropriate pay retroactively or the equivalent financial compensation.  

The Director General Military Careers, acting as Initial Authority (IA), denied the grievance. The IA considered that the grievance was inadmissible, explaining that the grievor had exercised his right to refuse regarding the CT offer. The IA explained that a CT offer is a proposal, not an obligation, and that members can freely choose to accept or refuse the terms of transfer. 

After learning from the Director Military Career Policy and Grievances that an error of 21 days had been made in the calculation of the EPZ date contained in the CT offer, the Committee found that the grievor had been aggrieved. However, the Committee found that the parameters for the proposed rank, pay rate and posting location seem to have been established in accordance with applicable policies. Furthermore, the Committee observed that the grievor later accepted another CT offer with the same parameters as the first offer, except for the posting location. Considering that an error in calculating the EPZ date was again made in the second offer, the Committee recommended that the Final Authority make the necessary corrections in the grievor's personnel file.
