The grievor disputed the rate he was charged for the single quarters he was assigned while he was on Imposed Restriction (IR) status when no others were available within the type prescribed for his rank. He claimed the base's internal policy regarding accommodations went against Defence Administrative Orders and Directives 5024-0, Department of National Defence (DND) Living Accommodations, and articles 28.20 and 208.50 of the Queen's Regulations and Orders for the Canadian Forces (QR&O). As redress, the grievor requested reimbursement of the overpayment. 

The Base Commander, acting as the Initial Authority (IA), denied redress. The IA found that the grievor was charged the correct rate for the type of accommodation assigned to him, in accordance with the rates determined by the Director Compensation and Benefits Administration 3. The IA further noted that the grievor was not obligated to stay in a room type with a higher charge as he was free to find accommodations on the local economy. 

The Committee noted that, per policy, the grievor's IR status gave him priority for on-base accommodations. The Committee found that subparagraph 208.50(1)(a) of the QR&O applied to the grievor's circumstances and, as he was charged a rate that was higher than the rate applicable to the type prescribed for his rank, the grievor had been aggrieved. The Committee recommended that he be reimbursed the overpayment. 

Regarding the grievor's contention that the base's internal accommodations policy went against various DND policies, the Committee found that it provided direction for allocating on-base accommodations to those who had been granted IR status. As for charges, it was the misapplication of subparagraph 208.50(1)(a) of the QR&O to the circumstances which resulted in overpayment. Given this, the Committee recommended that the Final Authority order a review of accommodation charges levied by the base on any other Canadian Armed Forces members on IR status in similar circumstances.
